TERMS & CONDITIONS OF HIRE
1. Definitions
“House of Wings” means Adora-Jane Bonadeo or any person acting on behalf of and with authority of House of Wings.
‘Hirer’ means the person named as the Hirer in the Hire Invoice, who signs or otherwise accepts this agreement personally or by an authorised agent.
“Apparel” means costume wings, wing carriers, costumes, additional accessories supplied on hire by House of Wings to the Client.
“Equipment” means collectively all the apparel supplied as described on any invoices or documentation provided by House of Wings to the Client at the commencement of hire.
“Period of hire” means the period the apparel is hired by the Client commencing on pickup and expiring on return of the equipment.
“Price” means the cost of the hire of the Apparel.
“Bond” means any sum to be paid by the Client and held by House of Wings as collateral.
“Deposit” means any sum which is stated as deposit.
“Damage” meaning but not limited to; tear, rip, destruction, holes, broken straps/handles, and excessive staining of wings, accessories and/or wing carriers.
“Normal wear and tear” encompass minor stains (small foundation or tan stains), stuck zippers, loss of feathers, falling out of metallic material.
“Special Conditions” means any special conditions as set out on hire invoice.
“Event” means photoshoot, celebration, competition that you intend to hire the Apparel for.
2. Price, Payment and Cancelations
2.1 The Price shall be the current price at the date the apparel is booked, according to House of Wings price list as listed available on request.
2.2 At House of Wings sole discretion, a Bond as stated on the hire invoice is required which shall be refunded to the client minus any cost of cleaning and/or repair of damage to apparel, if any.
2.3 At House of Wings sole discretion, full payment shall be due prior to pick up/delivery of the Apparel.
2.4 Payment can be made by bank transfer, cash or Eftpos with a 1.9% surcharge.
2.5 Payment via bank transfer is required to be cleared 1 week before period of hire.
2.6 Receipts by House of Wings of any form of payment other than cash shall not be deemed to be payment until that form of payment has cleared or been recognised.
2.7 A Non-Refundable Deposit is required to secure your date of hire, which will be issued on the invoice. This is to cover any work we do prior to your date of hire.
2.8 Should the Client wish to cancel the hire of the apparel within 1 week of their date of hire, the hire fee will be retained by House of Wings and the Bond refunded to the Client.
2.9 During the period of hire the Client is not eligible for refunds, exchanges or credit notes.
3.0 All prices are displayed in Australian Dollars AUD.
3.1 Cancelled Events. If your event is cancelled, your booking will be moved to another date and we are unable to offer full refunds.
3.2 By paying the invoice you are agreeing to these terms & conditions.
3.3 Shipping. The Apparel will be sent as soon as payment has cleared, we will not be held responsible if your Apparel does not arrive in time for your event if you do not pay your invoice on time. Shipping times are often delayed so we urge you to finalise your booking and invoice immediately, as we are not able to refund your payment if your Apparel does not arrive in time for your event. 3. Hirer’s Responsibilities
3.1 The Hirer Shall:
(a) Upon receiving the Apparel, shall inspect all apparel for defects or damage at pickup location.
(b) Notify House of Wings within 24 hours after the Pickup date, if the Hirer finds the Apparel is broken, damaged and/or defective. House of Wings shall assume if not notified within this time that the Apparel collected or received were in good order and condition.
(c) Immediately notify House of Wings of any damage to the apparel that occurs during the period of hire.
(d) On termination of the hire, return all equipment, in good order as received; normal wear and tear accepted at the discretion of House of Wings. Equipment returned after the agreed period of hire shall incur a late return fee.
(e) Return Apparel 2 days after their hire event (subject to special conditions).
(f) Not alter or make any additions to the apparel or in any other matter interfere with the apparel.
(g) Accepts full responsibility on the safekeeping of the apparel.
(h) We may ask for photo ID, credit card details or other forms of identification. We can refuse the right to hire if you are unable to provide the requested identification or document(s). (Will be removed off files, once hire complete).
(i) Ensure that the Apparel are used only for the purpose for which they were designed by the manufacturer and in accordance with the manufacturers and owner’s instructions/directions.
(j) Not authorise any other person or entity to use, re-hire or have possession of the Equipment at any time, unless expressly agreed to by House of Wings.
(k) House of Wings holds no responsibility for Hirers who have accidents, incur injury or death due to the hiring or wearing of hired Apparel.
(l) Communicate in a prompt manner, especially when we have reached out via multiple platforms – in regards to arranging fittings/pickups/returns and paying invoices. If the Hirer fails to communicate an appropriate time for pickup, this will result in deposit being kept and any additional money(s) paid being returned to the Hirer.
(m) Hirer must reuse the packaging – box, bubble wrap etc to repackage the Apparel upon return the Perth. Failure to do so will incur a fee from Pack & Send which will be taken out of the bond. (INTERSTATE)
(n) For interstate shipping, Hirer must be able to return the Apparel to their closest Pack & Send location.(INTERSTATE)
4. Breach
4.1 Without prejudice to any other remedies House of Wings may have, if at any time the Hirer is in breach of any obligation (including those relating to payment) under these terms of hire, House of Wings may repossess the Apparel, or suspend or terminate the supply of Apparel to the Hirer and any of its other obligations under the terms and conditions.
4.2 House of Wings will not be liable to the Hirer for any loss or damage the Hirer suffers because House of Wings has exercised its rights under this clause.
4.3 House of Wings reserve the right to keep all or part of the Bond if the Hirer is found to have breached the House of Wings Terms and Conditions.
5. Damage
5.1 If the apparel is returned to House of Wings late and/or in a manner deemed unworthy of rehire, this will result in either all/part of the termination of the Bond refund, depending on the type of damage.
5.2 If the apparel gets lost, stolen, damaged beyond normal wear and tear, whether or not such loss is attributable to any negligence, failure or omission of the client, then the client will be liable to pay for the replacement of the apparel. In assessing the replaceable value, House of Wings will take into account, the demand of the apparel in the market, the availability to repurchase the materials in the market, the condition of the apparel and the hire fee that has already been paid.
5.3 Excessively dirty apparel will incur a cleaning fee.
6. Late Fee Policy
6.1 You agree to return your product on the order return date.
6.2 If you return your item(s) late you will incur a thirty dollar ($30.00) late fee for every day you are late up to 200% of the retail value of the apparel.
6.3 You agree to pay these late fees up to an amount not exceeding 200% of the retail value of the products.
6.4 If you have not returned your product within 20 days of the return date your product will be considered a non-return and you will be charged 200% of the retail value of the item(s).
